FARMAX Training Terms and Conditions

1. Introduction

These Training Terms and Conditions (Terms) apply to training to be supplied by FarmIQ Systems Limited & FARMAX Limited (we, us, and our) to the entity procuring the training for its personnel or other nominated participants (you). 

2. Payment and confirmation of training   


After discussing your requirements with you, we will provide a written quote that covers all aspects of the training, including expected costs. We will invoice you once all variable costs are known.   

All training fees are to be paid in full by the date provided on the invoice. This will be charged to your currently nominated method of payment for the FarmIQ or FARMAX product unless otherwise arranged with the trainer. 

One tutor is required for every 6 people, with a maximum of 12 people trained in one session. Attendee numbers may be changed in discussion with the FarmIQ/FARMAX teams. 

3. Pre-requisites  


You will need a room big enough to comfortably hold all learners, with good wi-fi connections. Learners must supply their own phones, and, if required, you must supply sufficient laptops – minimum one laptop for every two users. For larger groups, a data display and a whiteboard are preferred, but not essential.  

You will be expected to organise and pay venue and catering costs, if any. If you need assistance with this, we can suggest venues and/or suppliers. 

4. Cancellations 

Cancellations by you 

If you need to cancel a training session, please give us as much notice as possible – preferably two weeks' notice or more – in writing via support@farmax.co.nz or support@farmiq.co.nz. You will not be charged for cancelled trainings, but if we are unable to get a refund on any flights or accommodation already booked then we may recoup these costs from you. 

Changes by you 

If you need to change the date and/or location of a training session, please give us as much notice as possible - preferably two weeks' notice or more – in writing via support@farmax.co.nz or support@farmiq.co.nz. We will change the training to a new date and/or location that suits your team and our trainer availability. You will not be charged for amended trainings, but if we are unable to get a refund or if we incur additional costs on any flights or accommodation already booked then we may recoup these costs from you. 

Cancellations or changes by us 

If we need to cancel a training session or change the date, we will endeavour to give you as much notice as possible in writing. If any venue or catering bookings you have made cannot be changed or refunded, please get in touch with our training coordinator and we can discuss.

5. Right to use training material  

All intellectual property rights in any training material provided by us are and remain owned by us. You and the attendees may only use the training material to assist in the proper use of any FarmIQ and FARMAX product, and for no other purpose. In this clause, training material includes any training manual, exercise, farm file or presentation. 

6. Liability  

Our liability under or in connection with the Terms or relating to the training must not exceed the fees paid for the training session to which the liability relates.  Without limiting the previous sentence, we exclude all liability for indirect, consequential or incidental loss or damage, or for loss of profit, savings, business, revenue, and/or goodwill, arising under or in connection with the Terms or relating to the training.
