“Farmax”, “we”, “us” and “our” are a reference to Farmax Ltd.

“You” refers to any user of the database, including your agents, employees and business partners and includes any corporate structure accessing information from the database.

“Accredited agents” refer to those legal persons, usually rural professionals such as accountants, farm consultants or advisors, who have been granted permission by Farmax to input and access the website as per our user agreement.

“Aggregate information” refers to information on the database which, when combined together, produces indicative statistical analysis in such a manner so as to disclose information based on certain data fields. These fields may be based, for example, on herd size, regions, breed, land patterns or irrigation systems. Farmax reserves the absolute discretion to determine the fields and statistical data on which aggregate information is based and to alter the same from time to time.

We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon publication on this website. Your continued use of the website following such publication will represent an agreement by you to be bound by the terms and conditions as amended.

Data on the Farmax website is entered by accredited agents from client financial and physical data, and personal knowledge. Farmax has no direct control over the accuracy of data captured on the database. The data will be subject to audit from time to time to check for validity and accuracy, but no warranty is provided by us as to its accuracy. We will use our best endeavours to ensure that training is provided to accredited agents on data entry. We also reserve the right to correct or adjust data where we deem it necessary to ensure data is of a suitable quality for its intended use.

All information provided by us pursuant to these terms and conditions is provided in good faith. You accept that any information provided by us is general information and is not in the nature of advice.

We do not make any representations or warranties that the information we provide is reliable, accurate or complete or that your access to that information will be uninterrupted, timely or secure. We are not liable for any loss resulting from any action taken or reliance made by you on any information or material posted by us.

Farmax and its Directors do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of this website or any linked website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this website. To the extent permitted by law, any condition or warranty that would otherwise be implied into these terms and conditions is hereby excluded.

You agree that the access of information and use of the website is being conducted in the course of your trade or business. Accordingly, the Consumer Guarantees Act or any replacement Act does not apply to your use of the website.
